An irrevocable trust is a trust that generally cannot be changed or revoked once it’s created, and that permanence comes with significant strategic benefits. By relinquishing control of assets to an irrevocable trust, you effectively remove those assets from your personal estate – providing a high level of protection from creditors and lawsuits. Because you no longer own the assets (the trust does), creditors or litigants often cannot reach them, which is why irrevocable trusts are a cornerstone of asset protection planning. These trusts can also offer tax advantages. For example, certain irrevocable trusts are used to reduce estate taxes for very large estates; assets placed in the trust, along with any future appreciation, may not count toward your taxable estate. (While Arizona has no state estate tax, federal estate tax can be a concern for high-net-worth individuals.) Irrevocable trusts are also used for specific purposes like life insurance trusts, special needs trusts (to provide for a disabled child without affecting government benefits), or charitable trusts. The key is that once you establish and fund an irrevocable trust, you’re making a lasting decision to benefit your beneficiaries in the exact manner you’ve spelled out, with very little ability to change course later – so it must be done with careful planning and foresight.
Bellah Law’s estate planning team has extensive experience creating and managing irrevocable trusts tailored to our clients’ needs. We guide you through the process thoughtfully: from deciding which type of irrevocable trust suits your goal (be it asset protection, tax reduction, or providing for a loved one’s special needs) to drafting ironclad trust documents. Our attorneys explain the pros, cons, and long-term implications in plain language, making sure you are comfortable with “locking in” your plan. Because irrevocable trusts are, by nature, inflexible once established, our client-first approach is to meticulously plan up front – considering various scenarios and building in lawful provisions for future flexibility where possible. With decades of experience in Arizona trust law, we also ensure your trust complies with state statutes and takes advantage of all available legal strategies to protect your assets. And if down the road there is any dispute or need to petition the court (for example, to modify an irrevocable trust under Arizona law in special circumstances), our trial-ready attorneys are prepared to advocate for you. Throughout, our bilingual staff is available to assist and update you (en inglés o en español) so you never feel lost in the process. With Bellah Law, you can create your irrevocable trust with confidence, knowing your legacy is secured by a team of seasoned professionals.
